By accessing or using Check In Chief's mobile application and services ("Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our Service.

2. Description of Service

Check In Chief is a team attendance management application designed for coaches and team administrators. The Service allows users to:

  • Create and manage teams
  • Send attendance notifications via SMS and push notifications
  • Track team member responses and attendance
  • Manage events, practices, and games
  • Organize team information

3. User Accounts and Registration

3.1 Account Creation

To use our Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update your information as necessary to keep it accurate.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Account Eligibility

You must be at least 18 years old to create an account and use our Service. By creating an account, you represent that you meet this age requirement.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service in any way that violates applicable laws or regulations
  • Send unsolicited or unauthorized communications (spam)
  • Harass, abuse, or harm other users
  • Impersonate any person or entity
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any part of the Service
  • Use automated systems to access the Service without permission
  • Collect or harvest personal information of other users

5. SMS and Push Notifications

By using our Service to send SMS and push notifications, you agree that:

  • You have obtained proper consent from all team members to send them notifications
  • You will comply with all applicable laws and regulations regarding SMS communications
  • You will not send spam or unsolicited messages
  • You will respect opt-out requests from team members

Standard message and data rates may apply for SMS notifications. We are not responsible for any charges incurred by you or your team members.

6. Subscription and Payment

6.1 Subscription Plans

Check In Chief offers subscription-based pricing. By subscribing, you agree to pay the applicable fees as described at the time of purchase.

6.2 Billing and Automatic Renewal

Subscriptions automatically renew unless cancelled before the renewal date. You authorize us to charge your payment method for the renewal fee. We will provide advance notice of any price changes.

6.3 Cancellation and Refunds

You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. We do not provide refunds for partial subscription periods unless required by law.

7. Intellectual Property

The Service and all content, features, and functionality are owned by Check In Chief and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our express written permission.

8. User Content

You retain ownership of any content you submit to the Service (e.g., team information, event details). By submitting content, you grant us a license to use, store, and process your content solely to provide the Service.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHECK IN CHIEF SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify and hold harmless Check In Chief and its affiliates, officers, agents, and employees from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

12. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Service will immediately cease.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Effective Date." Your continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Check In Chief operates, without regard to its conflict of law provisions.
